Scotland Yard is looking into a complaint from a retired police officer that John Prescott broke the law by having sex with his secretary in his office.
Tracey Temple, Mr Prescott's civil defence secretary, said that the couple had sex in his Whitehall office while they were at work.
Although the deputy prime minister admitted the affair, he said many of Ms Temple's allegations were not true.
The formal complaint was made by former Glasgow police officer Alistair Watson who wrote to Metropolitan police commissioner Ian Blair saying that Mr Prescott may have committed the offence of misconduct in public office.
Mr Watson said he was making the complaint "in the interest of equality of justice", according to the Sunday Times.
In the letter, he referred to the case of a Greater Manchester constable who was sentenced to 200 hours of community service last year for having sex with a woman at her home three times while he was on duty.
"This is not malicious," Mr Watson said. "If there are rules that apply to ordinary people, John Prescott should be treated the same, or more harshly."
A police spokeswoman said that the complaint would be considered in due course, and that any decision on further action would be made by the Crown Prosecution Service.
