Ferrari have applied for an injunction to proposed rule changes about a budget cap in F1.
The Italian giants are among the teams who have threatened to withdraw at the end of this season unless an optional £40million budget cap next year is scrapped.
Ferrari claim the new rules are a breach of a "technical veto" they had concerning any amendments to regulations.
FIA president Max Mosley, F1 chief Bernie Ecclestone and team representatives held talks but there was no solution to the row. Another meeting is scheduled in a fortnight.
Mosley claims he was told of the injunction by text message during the discussions. Ferrari's application for an injunction is scheduled to be heard in Paris on Tuesday.
The FIA president said: "During the meeting it became apparent that Ferrari have made an application to the French courts to apply for an injunction to stop us doing what we want to do.
"When people start bringing proceedings it is very difficult to negotiate with them," he said.
"It was a friendly meeting but the teams have gone off to see if they can come up with something better than the cost cap.
"The regulations are as published. We have explained that we want everyone to race under the same regulations."
The FIA want an optional £40m budget cap to encourage new teams to enter, with those teams operating under the budget allowed more
technical freedom than those continuing with unlimited funds.
Mosley added that the FIA would sanction a breakaway, adding: "We would have to do that and we would do that. If they did a breakaway they could write their own rules and we'd check them for safety."
