Struggling Sheffield United have written to the Football Association (FA) to appeal Claude Davis' controversial red card against Everton on Saturday.
The defender was given a straight red after only 30 minutes of the Blades' 2-0 defeat after tangling with striker Andrew Johnson at Goodison Park.
Television replays showed there was minimal contact before James Beattie slotted home the resulting penalty to give David Moyes' side the lead.
If the Blades' claim for wrongful dismissal is rejected, Davis will miss the Carling Cup tie with Birmingham along with tricky Premiership matches against Chelsea and Newcastle.
Outspoken United manager Neil Warnock said after the match that referee Dermot Gallagher had blown for a foul too early.
He also controversially said Gallagher "should have retired last season" and felt he was holding younger referees back.
The match was Gallagher's first since being demoted for failing to reprimand Manchester City defender Ben Thatcher after his infamous elbow on Portsmouth's Pedro Mendes in August.
The FA's disciplinary commission will consider the Blades' claims tomorrow.
Warnock is expected to make several changes for tomorrow's Carling Cup tie against the Blues with Paul Ifill, Ade Akinbiyi, Derek Geary, David Unsworth and Nicky Law set to feature.
David Dunn and Matthew Upson will miss the match for the Championship side through injury.
