Sheffield United chairman Kevin McCabe is confident his club will be reinstated to the Premier League when the club meets with an arbitration panel in two weeks about the Carlos Tevez affair.

McCabe wants West Ham to be docked points for the way they handled the transfer of Tevez last summer rather than the fine that the Premier League handed out in May.

Speaking to the BBC he said: "I firmly believe we will win and the previous decision will be overturned."

Tevez was instrumental in keeping West Ham in the Premiership, scoring some vital goals – including the winner against Manchester United on the final day of the season.

McCabe feels that the Premier League got their initial decision to fine West Ham £5.5 million wrong, and that a points deduction should be applied retrospectively, thus allowing his side back into the top flight.

He said: "There were circumstances behind the wrong decision but we've looked at it and consulted with our lawyers and we're confident that the arbitration will overturn it.

"An injustice has been done - a club that played within the rules has been relegated and a club that breached the rules has been rewarded."

McCabe said he had been assured reinstatement by officials if the original decision is overturned in arbitration.

But he conceded that while the arbitration decision was critical to their hopes the club would pursue other legal recourses if the decision did not go in their favour.
