Nickelback singer Chad Kroeger has decided to abandon his appeal against a drink-driving conviction.

The 33-year-old frontman was stopped in June 2006 by police in Surrey, Canada, after his Lamborghini was tracked at 160km (100mph) per hour.

His blood alcohol level was found to be nearly twice the legal limit and he was banned from driving for 12 months at a hearing in Vancouver last year.

The Rock Star singer was also fined C$600 (£329).

At the time, the singer's defence team said they planned to appeal the conviction on the grounds that Surrey police had taken a breath test unlawfully when they arrested Kroeger.

Speaking to the Vancouver Sun newspaper, Kroeger's lawyer said the breath sample should not have been admissible as evidence to the way in which it was obtained.

However, a similar case has since been abandoned by the British Columbia Appeal Court, meaning Kroeger's appeal is now inadmissible.

"Just like anybody else his rights are protected by the charter and at the time of the trial we felt that his rights had been violated," said Kroeger's lawyer Marvin Stern.

"The state of the law has now changed and we respect the current state of the law and are bound by it and in law there's no ground of appeal left."

Nickelback were this week nominated for best single, best group, best producer and best album of the year at the Juno awards, Canada's national music honours.
