The former cleaner of attorney general Baroness Scotland has been charged with immigration offences.
Otolose Loloahi Tapui has been charged with possession of a false identity document (passport), fraud by false representation and overstaying her leave to remain in the UK.
She is due to appear at City of Westminster magistrates' court on December 7th.
Simon Clements, head of the CPS, special crime division, said: "Following an investigation by the UK Border Agency, I received a file of evidence on November 9th.
"I have decided there is sufficient evidence and it is in the public interest to prosecute these offences."
Her husband Alexander Zivancevic has accepted a caution for assisting unlawful immigration but will not face further charges.
Baroness Scotland sacked her cleaner when her immigration details were revealed.
She said the Tongan had been employed in good faith and had no reason to suspect she was working in the UK illegally.
