Lindsay Lohan has been caught drinking at a New Year's bash after checking out of a US alcohol rehabilitation centre in October.
The star's lawyer admitted that Lohan had taken a swig of champagne straight from the bottle at a party in Capri, Italy.
Her attorney Blair Berk told People magazine: "After being handed a champagne bottle while on a dance floor in Italy on New Year's Eve and drinking from it, the good news is that Lindsay stopped herself, called her sponsor, and got herself back on track.
"There is no magic cure here. The most unfortunate part of this is that Lindsay has to share her 'one day at a time' with the entire world," Berk added.
Lohan checked into the Cirque Lodge treatment centre in August and temporarily left behind her high-flying Los Angeles lifestyle to seek treatment for her alcohol problems in the US state of Utah.
The Mean Girls star recently served a one-day prison sentence and completed community service at a blood donor centre as part of her plea bargain for driving under the influence.
