Rob Lowe asks court to dismiss nanny's pay claims

Rob Lowe requests court dismiss former nanny's wage claims
Rob Lowe has requested that a court dismiss a former nanny's claims of wage violations, it has been reported.

Jessica Gibson, who worked as a nanny for the actor and his family on and off over a seven-year period, has claimed the West Wing West star touched her inappropriately on several occasions between September 2005 and January 2008.

And she has also has alleged a number of violations of US labour codes of conduct, including unpaid overtime and meal and rest periods which she claims to be owed.

Lowe's lawyer, Larry Stein, has moved to dismiss the wage claims made by Ms Gibson and requested that a Santa Barbara, California, court strike these portions from her countersuit, according to People magazine.

"Each of Gibson's [accusations] is completely unfounded... but nine of those ... are subject to immediate dismissal because she has failed ... to even allege the essential elements of a claim of relief," he writes.

However, the Wayne's World actor has not requested that Ms Gibson's claims of sexual harassment be dismissed, seemingly aiming to have them proved unfounded in court.

The 44-year-old, who played Sam Seaborn in The West Wing, has called Ms Gibson's claims "an attempt to damage and humiliate not only my wife and me, but our two young sons as well".

A second nanny, Laura Boyce, has also brought sexual harassment charges against the family, accusing Lowe's wife Sheryl of "behaving in a... perverted, disgusting and crude manner", in a countersuit filed in Los Angeles earlier this month.

Mr Stein attacked Ms Boyce's claims for their apparent attempt to add weight to Ms Gibson's countersuit by naming Rob Lowe in the legal action.

"Although framed as a sexual harassment claim against both Sheryl and Rob Lowe, the cross-complaint alleges only words by Sheryl and never mentions any words or conduct by Rob whatsoever," he argued.

"The alleged statements by Sheryl are totally unrelated to, and do not provide any support for, Ms Gibson's claims against Rob."End of story
